Declare it on who? And on what grounds? Piracy is a law enforcement issue, it's not an act of war.

There have been times where pirates were funded by nations and sanctioned to attack other nations. This isn't true here. Somalia isn't hiring these people as privateers to attack American ships and American citizens. We're not talking about the Barbary States, nations demanding tribute not to attack ships. These are just common thugs robbing ship. The historical link you're referring to is weak at best.
It'd be like wanting to declare war on a nation because people from there are committing highway robbery.
Historical reasons to go to war aren't always valid in modern times anyway.
So set up a zone in which legitimate fishing enterprise may take place. Leave the zone...

Maybe, but they were going to the Red Sea so they couldn't have been too far. The pirates are operating thousands of miles off the coast now, half the damn Indian Ocean is now pirate terriitory.
