I'm coming around to your point of view on this crucial issue, and I think that giving him the new nickname "Leak" will be more accurate, more scatalogical and more alliterative all at once.

No jail scenarios:
1. found guilty but wins appeal on technicality (a la Ollie North)
2. cooperates, plea bargains and gets no jail time.
3. found not guilty
4. pardoned
5. dies before appeals fully exhausted.
6. flees, maybe even the country.
7. other?

He is facing, I hear, 20 years and $500,000 fine. Legel expenses of what? Say $1,000,000.

This guy is facing absolute ruin. He is also not as known as say an Ollie North or Bill Clinton that can speak and get broadcast gigs for big bucks. Clearly they are looking for him to incriminate someone else highrer up. Who might that be? Chaney, Rove, Bush. That is about it. I think Scooter is sweating about now.

I don't know what laws cover this but generally I think that public employess that incur legal fees as part of their work are covered. It seems like it's not absolute but I'm not sure what triggers a cessation in legal fee coverage. I wouldn't look for Bush to lead a charge to cut off his legal fees anytime soon.

On the rest I totally agree. But my gut tells me that he's not going to be left to take a big fall for this. The manipulated leaks that were part of dealing with Wilson were a big part of the way things were done at the white house and I don't think people in power will feel too good about seeing one of their own go up the river for something that was just standard operating procedure for the Bush administraton.

One thought that occurred to me was that he might not want to even think about plea bargains right now. He might adopt a strategy of delaying the end of appeals until right around the end of Bush's term so that he hits the sweat spot for presidential pardons. Spilling his guts out now may not be the best strategy if he decides to play for a pardon.

He isn't an employee anymore Can you imagine the crap if the government paid his expenses? Not to say that some republican lawyers might not do some pro bono work though..

I doubt they are even returning his calls at this point. But I think he is too smart to even place them.

I thought you were probably wrong Ed, but maybe I shouldn't doubt a god.

I went looking for some kind of direct information on this and didn't find anything that directly applied.

I did find that Clinton has applied to have his legal fees reimbursed for the Whitewater. Apparently a provision of the independent counsel law allowed for that if he wasn't indicted.

Extrapolating from that it sounds like it is not as automatic as I thought that a person's legal bills that he incurs as part of his government job were covered (although maybe Clinton's whitewater legal bills were viewed as not job related). I wonder if Libby's bills have been covered up to now. Maybe he had access to in house counsel for free . But when he got his own lawyer he paid for that. Certainly in the private world executive officer's legal fees are often paid by insurance when the executives get themselves in trouble for various reasons.

At any rate Libby's probably got a few bucks stashed since he was a private lawyer and mark rich was a long standing client.
 
Does deal to get off jail-time if he signs up and fights in Iraq. Where he meets with an unfortunate accident involving his billet and a fragmentation grenade. (By sheer good fortune, nobody else is hurt.)

Not likely. He's still more or less in the service of the Republican party. The last thing they want to do is stretch this out untill the next round of elections. I'm sure there is adequate money in the GOP coffers to make sure they can cut him a deal whereby he fades from sight with a slap on the wrist or perhaps a short stint in one of the country-club prisons.

I'm drawn to that kind of conclusion, if it can be done. The White House is surely looking for a "new beginning", cleaning house and ushering in a New Morning in 'Murrica. I've heard estimates of 18 months minimum before the case comes to court if he fights it. Too long, in my opinion.

So he takes one for the Boss, pleads guilty on a technicality - yes he told untruths - while holding to the "honest mistake" story. Then gets out on bail for 40 years of appeals against sentence, all paid for by Confederate gold. Cheap at half the price, as the saying goes.
