Allegations of nonconsensual sex on set of reality TV show

I don't watch this sort of stuff myself, but the report of what transpired interested me so I thought I would pass it along and see what others think about this:

I know there's a limit to how much you can quote here, but you should probably just read the whole thing. It isn't very long.

Portions that stick out to me:
Several media outlets have reported that BIP contestant DeMario Jackson allegedly had a nonconsensual sexual encounter with contestant Corinne Olympios in a hot tub during filming. Sources connected to Jackson told TMZ that Jackson had oral sex with Olympios, that he was too drunk to have penetrative sex, and that “the next day everything was fine.” Sources close to Olympios told TMZ that Olympios said she does not remember and did not consent to the sexual encounter. Warner Bros. is investigating the incident and won’t comment on specifics for now.

The BIP crew member told the Daily Mail that the incident occurred after producers suggested Jackson and Olympios hook up. “Corinne and Demario found out when they arrived in Mexico that the story line would involve the two of them hooking up so they decided to hang out and get better acquainted over drinks,” the source said. “Soon they decided to go swimming and when they climbed into the Jacuzzi, they were both loaded. Corinne proceeded to remove her bathing suit and things got increasingly sexual.”
Somewhere in the midst of this encounter she went limp and unresponsive, but he kept going and they kept filming, but at some point crew members stopped it and carried her away.
Another story from the NY Post:

Olympios has reportedly hired an attorney and is said to be blaming producers for allowing the sexual encounter with Jackson to progress despite her apparent inebration. Both parties were said to have been drinking throughout the day of shooting, though Olympios claims she was in a blackout state and was unable to consent.

So, yeah. They were both very drunk, but she was so drunk that she can't even remember what happened. This happened after the shows producers supplied them with alcohol throughout the day and "suggested that they hook up". It seems like someone should have intervened much earlier if she was so drunk.

No it would be legally sexual assault when he didn't stop when she passed out. Being black out drunk doesn't change legal standards for your actions. Being unresponsive does.

Maybe he was too drunk to notice. Given that, in these instances, being too drunk to notice absolves one of responsibility, then he probably has a reasonable defence.
 
It appears the reality TV show got cancelled for having actual reality in it.

Actually it does. They were arguably both too drunk to consent. In that case, both committed sexual assault.

You are mixing up moral theory and legal theory. If this worked as legal theory you could get out of drunk driving convictions by being too drunk to know what you where doing when driving.
 
She said that she blames the producers more than him. Given the circumstances that led up to it, I tend to agree. They should have noticed how drunk they both were before they got into the hot tub.

Why? Drunk hot people makes great TV. That is why alcohol always flows freely on the sets of reality TV shows.

Umm, hmmm. I honestly don't really understand the appeal of these shows myself. But that's OK, different strokes for different folks. But I'm sure there's a lot of things that would make for really great TV but making them would be too unethical. Say they brought back Roman Gladiators to fight to the death. A lot of people would probably want to watch that. I'm just saying they could be a little more careful to avoid a legally and morally dubious situation like this one.

No, that's my point. Neither of them can use their drinking as an excuse for a sexual assault. That's legal theory 101. Self induced intoxication is to be disregarded as a mitigating excuse if you do stupid stuff and break the law.

But OTOH, you can in many countries, e.g Canada, be so intoxicated that you have been rendered incapable of consenting.

Do you spot the legal paradox?

If to people drink so heavy that they are rendered incapable of consenting, and up in the sack - they can BOTH be convicted of rape/sexual assault. (if you are in a country where female rape is illegal, that is..)

Would your comment imply that it is only being blackout drunk that should be a consideration for anyone in these situations? That someone merely very, very, very drunk, but still being able to slur out a few words and walk upright two times in three is entirely responsible for their actions in these situations?

Does anyone know what prevalence is of alcohol-induced amnesia. Not saying anything about this case directly, but I've never suffered it, and tend to think that some/many people use it as a "plausible excuse" for something they subsequently regret.

I've been blackout drunk plenty of times.

They're entirely responsible when they're behind the wheel of a car. Why not here?
