Youtube smackdown: VFX Vs Thunderf00t

For those not following this rather amusing situation, Thunderf00t, one of the more prominent YouTube Atheist posters and VenomFangX, a rather retarded Creationists are in a bit of a bitch fight on YouTube.

VFX allegedly attempted to censor Thunderf00t by filing a DMCA take down notice against some of tf00t's videos(and apparently hundreds of other atheist YouTube posters). In the process VFX had apparently filed false DMCA charges since he doesn't own the copyright to those videos.

Tf00t has given VFX and ultimatum, to either leave youtube willingly for 1 year or be reported to YouTube and be sued for apparent perjury. The deadline is this Tuesday 9/23/08.

While I find the whole thing rather childish, mostly from a very lame and dishonest VFX, I do find it amusing that one of the more offensive Creationist and rant crazy fundies is getting a beat down for lying.

Well, while there are certainly bigger current issues that are at least as childish
as that, I agree with you regarding the fact that the Creationist obviously ran
out of arguments ... for some reason ... Funny ****, indeed. :D
 
I love tf00t's videos; his series on why people laugh at Creationists was great. My only question is why give VFX the option? Maybe I'm just petty but I would have reported VFX to youtube and taken him to court.
 
I guess he was trying to be fair. The point of his ultimatum was that he wouldn't pursue charges against PCS (VFX) which would save both time and money on both parties, and hopefully to let PCS spend some time away to think about what he is doing.

In one of Thunderf00t's latest videos on the subject has snippets of a PCS video where he firstly would make Heath Ledger spin in his grave, and then accuses Thunderf00t of blackmail.

Apparently PCS was actually warned that the videos that he filed DCMA's against were most likely not copyright violations.

2)You need to read the relivant section of the DMCA slightly more closely.

Thunderf00t is having a very productive team-up with his lawyer. VFX admitted his guilt by admitting exactly how he sanctioned false DMCA's, and the person who did file some on his behalf, TogetherForPeace, who has had the conscience to come clean about the whole thing, has confirmed that VFX went the extra mile to file the false DMCA's against Thunderf00t himself. By hand, not by proxy.

Childish? No. It's serious. Infringing on people's free speech and the fight against that behavior is never childish. Childish is referring to anything that plays out on the internet as childish or "drama." It shows you don't really have any understanding of the gravity of the situation.

It is this sanctemonious over reaction that I find internet bitch fights childish. Oh, I understand the situation very well, I understand the gravity of the situation. I just don't act all huffed up and all indignant if someone doesn't take me seriously on the internet. Now, that's childish.

While you make a good point Pax I must point out that VenomFangX is impossibly irritating.

The threat of perjury (for which there have been about zero prosecutions) turns up under:

"A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed"

The "statement that the information in the notification is accurate" is not made under penalty of perjury. The penalty of perjury bit applies to the second half and since they are claiming it is their material that has been nicked I think it is fairly safe to say that they have been authorised by themselves (unless they are under 18 then it gets messy).

Which actually perplexes me to be honest. Since this incident happened and tf00t made his ultimatum clear VFX has lied, threatened, and mocked tf00t. I honestly don't know how tf00t puts up with it. If I had made such a generous offer and someone responded to me by insulting me and spitting on my offer I would be eagerly awaiting the deadline and hoping he would say no just so I could take him to court.

Actually tf00t did just a post a new video about this in which he discussed a legal precedent in which the loser of the case was forced to read an apology to the internet promising never to file a false DMCA again.

I agree with the guy in the video you posted Wildly. What VFX is doing is wrong, it's illegal, and it's a violation of free speech. tf00t is letting VFX off the hook for, what appears to me, to be purely selfish reasons. There are plenty of other examples of creationist stupidity out there that need to be addressed other than just the usual suspects.

I'm a bit confused really. I can understand both sides of the argument based on what I know, and this issue seems to have divided the Youtube community.

I do want to hear more from thunderf00t though, there is quite a bit of information that has been left out that could really solve the problem.

Does VFX have to keep comments open and unmoderated for that video?
Can others post it, a la VenomFongX, without getting in trouble?
 
TMA makes a great point, and maybe I am being very rash when I rush to condemn tf00t for not putting VFX under the knife. And maybe he is right that it's better to have a live opponent admit defeat than a dead one say nothing but this still feels odd to me. Maybe I should just be thankful that incidents like this involve cooler heads than mine?

No offense, but this seems to be a tad more serious than mere highschool drama. Granted I think it's a little ridiculous that they've both decided to make this argument so public.
