Underage drinking crackdown

Ashley Berden, who was 18, went to a party at her friend's house and left her purse there. Fortunately, the police found the purse.

The police kindly called her and let her know about the missing purse. Just kidding. They went to her home at 4AM and demanded she take a breathalyzer test to determine if she had be drinking. She was informed that if she did not take the test, she would be taken to jail.

I am from the Detroit area and considered gigging in Ann Arbor to be a great experience. Glad the cops never hassled me.

That said - There isn't much else for the cops to do in that town but harass people who don't deserve it.

ETA-

I am still appalled at their actions. That they have nothing better to do isn't an excuse. Just perspective.
 
The American Civil Liberties Union of Michigan has challenged a law that allows police to issue Breathalyzer tests to civilians under the age of 21 without a search warrant.

I think this law really sucks IMHO, but according to the article, it is the law where the arrest happened.

If folks there don't like it, they need to vote to repeal the law.

Well, if a relevant court can be convinced that the law itself is unconstitutional (and I could put together a strong case that it violates the prohibition on unreasonable searches), then the court will issue an injunction prohibiting its enforcement.

That's probably what the ACLU wants.

And more power to them, sez I.

Yes but the Detroit area has other things to be shameful for.

Drinking is legal in Windsor, Ontario, at the age of 19. So all the 19 and 20 year olds hit the road for Canada to go drinking. They got smart and had a designated driver.

So the Michigan legislature passed the law that it was illegal for people under 21 to be drunk, even if they got drunk where it was legal for them to get drunk.

So they sit at the border looking for same, now.

See, you're mature enough to go kill Iraqis, or get your legs blown off, or get captured and have your head sawn off, but you're not mature enough to drink.

Keep in mind, conservatives, that the 21 rule is designed to keep alcohol out of high schools. How is going to Canada on Friday night of any impact on this?

I remember going to windsor when I was 19. When did they pass that law? That sucks completely. I moved to the twin cities from ferndale in '02. then again, I turned 21 in the 90's, so maybe I just wasn't paying attention because Royal Oak was now open to me.

The 21 rule is designed to prevent drunk driving kids from getting killed.

I think the law is awful but there is a difference between giving someone a breathalyzer test at a party and going to her house to give it to her. This goes well beyond awful and in the realm of absurdity. It is almost as if the police are trying to get people pissed at them.
