Predictions: Result of Trump's NY fraud lawsuit

Trump has his upcoming New York lawsuit scheduled to start October 2. (This case was brought by Attorney General Leticia James, over Trump and his company committing Fraud by overvaluing property values when Trump was trying to borrow money).

A judge has already ruled that Trump is liable in a ruling earlier today, and has suspended some of Trump's business licenses. (See: Reuters).

It is a civil (not criminal) lawsuit, so Trump won't be going to jail over it. But, the lawsuit is for $250 million. (Furthermore, Trump could be barred from doing business in New York as a result.) So, it could definitely hurt, given the fact that he still has substantial business interests in New York.

So what do people think will be the ultimate result of the trial?

Otherwise Trump Org will go into receivership and be dissolved. The financial penalties haven’t been decided at this point, but Trump and his sons cannot do business in the State of New York anymore.

Locking up Letitia James, Jack Smith, Hillary Clinton, Obama, every Democrat in Congress, and the whole Biden family is the fantasy that keeps him going. It might even happen.

Even if Trump never pays a dime (stiffs the government, ties the payments up in appeals, etc) there is the possibility that he will have his business licenses revoked, and that is much harder to get around. Given the fact he still has things like Trump tower, a hotel, a golf course, etc. in the state, losing the ability to run them will probably hurt more than any fines.

If I remember correctly, Ivanka was named in the suit initially, but back in July 2023 an appeals court had her removed (under the argument that she had "left the business" to advise her father when he became president, so her involvement was too far in the past)

It is likely to be a hell of a lot more. But the money is only part of the ruling. The judge ordered the dissolution of the Trump Organization and associated LLCs.

Melania can also do business in NY too, should she ever want to revive her successful career, posing naked in photos.

The thing I am hoping for most is that a successful civil case against the Trump organization will give Alvin Bragg enough of a backbone to initiate criminal charges against Trump and his Klan for more than just falsifying business records over hush money payments. (I would love to see the indictment count get over 100)

Trump, in a series of statements, railed against the decision, calling it “un-American” and part of an ongoing plot to damage his campaign to return to the White House.

“My Civil rights have been violated, and some Appellate Court, whether federal or state, must reverse this horrible, un-American decision,” he wrote on his Truth Social site. He insisted his company had “done a magnificent job for New York State” and “done business perfectly,” calling it “A very sad Day for the New York State System of Justice!”

The scathing decision by Justice Arthur Engoron of New York state court in Manhattan will make it easier for state Attorney General Letitia James to establish damages at a scheduled Oct. 2 trial.

Engoron also ordered the cancellation of certificates that let some of Trump's businesses, including the Trump Organization, operate in New York, and ordered the appointment of a receiver to manage the businesses' dissolution.

The judge also sanctioned the defendants' lawyers for making "preposterous" legal arguments and fueling their clients' "obstreperous" conduct.

"It's a devastating ruling," said Bill Black, distinguished scholar in residence for financial regulation at the University of Minnesota Law School.

He said cancelling business certificates could hurt Trump's ability to make money.

"If the decision is upheld, they have to liquidate the LLCs which actually hold the enormous bulk of the assets," Black said, referring to limited liability companies.

In a post on his Truth Social platform, Trump called accusations that he committed fraud "ridiculous and untrue," and blasted Engoron as a "DERANGED" judge doing the bidding of James, a Democrat.

"This is Democrat Political Lawfare, and a Witch Hunt at a level never seen before," Trump wrote. "If they can do this to me, they can do this to YOU!"

No not Trump directly. But if the businesses he owns has to pay 250 million to billions of dollars it will certainly affect his bottom line.

The amount of the penalties will be determined during the trial. The question will be the amount of the disgorgement. How much money will his businesses have to give up to cover their ill-gotten profits.
