The leader of something called The European Council for Fatwa and Research is defending the Iraqi thugs who mutilated the corpses of four U.S. businessmen killed earlier this week in the city of Fallujah, saying the barbaric practice is "permissible" under Islamic law under certain circumstances.

It took me a while to realize that this NewsMax site is actually a serious news site and not a parody like the Onion.
I mean, for god sakes they have an online store that sells an Ann Coulter doll that spews anti-Liberal propoganda when you press a button.
Hmm, should I expect objective journalism from them?

Firstly, you site the newsmax story (I won't go into newsmax's reputation people can view thier site and make thier own conclusions)

Sourcing an April 1 report in Islam Online, the Middle East Media Research Institute noted Friday:

"In response to a question about the legality of mutilating corpses of enemies during wartime, Sheikh Faysal Mawlawi of the European Council for Fatwa and Research stated that such acts are generally forbidden, but are permissible if they are in response to similar acts by the enemy."


Now the "middle East Media Research Institute" (memri) Is, in my opinion, an organisation that is essentially a propaganda wing of the Israeli Government. Google up the memri site and draw your own conclusions.

Responding to the question, Sheikh Faysal Mawlawi, Deputy Chairman of the European Council for Fatwa and Research, states the following:

"Firstly, it is not allowable to torture the living or mutilate the dead even if they are non-Muslims. In the hadith of the Prophet (peace and blessings be upon him) when he was sending Hamzah Al-Aslami in an expedition, he instructed him saying: "If you find so and so, kill him. But never kill him by burning, for none uses fire in torturing except the One Who created it (i.e. Allah)." (Reported by Abu Dawud)

In another hadith, Safwan ibn `Assal said: "The Prophet (peace and blessings be upon him) sent us in an expedition and said: 'Move under the protection of Allah and for the sake of Allah. Fight those who disbelieve in Allah but never mutilate (the dead).'" (Ibn Majah)

Secondly, it is permissible to mutilate the dead only in case of retaliation. If any one cuts the ear of another, his ear is to be cut in return. If he inflicts any physical damage on anyone, he should be retaliated against in the same manner. In case of war, Muslim are allowed to take vengeance for their mutilated dead strugglers in the same way it was done to them. Almighty Allah says: "If ye punish, then punish with the like of that wherewith ye were afflicted. But if ye endure patiently, verily it is better for the patient." (An-Nahl: 126)"


It is plainly obvious that Mawlawi is not "defending" this action but offering the conditions under which body mutilation is not a sin as the SECOND reason he condemns the action....simply because that condition does not apply (revenge for the same act).

Memri misreports it Newsmax jumps onto it, The richard G bot posts it on Jref....Thats how this sort of garbage ends up on here.
